Welcome to Vycinity. By downloading, accessing, or using the Vycinity mobile application or website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. About Vycinity

Vycinity is a two-sided marketplace that connects individuals who need tasks completed ("Hirers") with skilled individuals available to complete those tasks ("Workers"). Vycinity facilitates the connection and payment process but is not a party to the agreements formed between Hirers and Workers.

2. Eligibility

You must be at least 18 years old to use Vycinity. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

You must create an account to use most features of the Service. You agree to:

We reserve the right to suspend or terminate accounts that violate these Terms or that contain false or misleading information.

4. Identity Verification

To post gigs or apply for gigs, users must complete identity verification through Stripe Identity. This helps maintain a safe and trustworthy community. Verification is a one-time process and your ID documents are handled solely by Stripe. Vycinity does not store copies of your identification documents.

Hirers may post gigs describing tasks they need completed. Workers may apply for open gigs. By posting or accepting a gig, you agree that:

6. Payments and Fees

All payments are processed by Stripe. By using payment features, you agree to Stripe's Terms of Service.

When a Hirer accepts a Worker's application, a payment is held by Vycinity. Upon gig completion, the payment is released to the Worker's connected bank account. The following fees apply:

Free Worker monthly job cap. Workers on the free plan may complete up to three (3) gigs per calendar month. The cap resets at 00:00 UTC on the first day of each calendar month and counts only gigs whose status is "completed." Worker Premium subscribers have no monthly cap and may accept and complete an unlimited number of gigs per month.

Fees are subject to change with notice. Subscriptions auto-renew unless cancelled. iOS subscriptions are managed through Apple and are subject to Apple's subscription terms.

7. Escrow, Auto-Release, and Disputes

When a Hirer accepts a Worker for a gig, the gig payment is captured and held in escrow by Stripe on behalf of Vycinity. The funds remain held until one of the following:

Disputes. Either party may report a problem from within the conversation during the accepted phase. Submitting a dispute pauses auto-release and freezes the held funds. Vycinity will review the gig, the conversation, the worker's proof-of-work photo (if uploaded), the in-app check-in record, and any other relevant evidence, and reach a resolution within a reasonable time. Resolutions may include full release to the worker, full refund to the hirer, or a partial split. By using Vycinity, you agree to Vycinity's good-faith resolution as binding for the purpose of escrow release.

Check-in code. When a gig is accepted, the app issues the Worker a 4-digit check-in code. When the Worker arrives at the gig location, they show the code to the Hirer, who enters it in-app to record an arrival timestamp. Check-in is optional but strongly recommended for in-person gigs. It creates an audit trail Vycinity uses to resolve disputes.

Proof of work. Workers may submit a photo of finished work in-app. Hirers view it inline before marking the gig complete. Vycinity recommends proof for any gig with a visible deliverable.

8. Off-Platform Payment for Vycinity-Listed Gigs Prohibited

Any gig posted on Vycinity must be paid through Vycinity. Once a gig is listed on the platform, you may not arrange, suggest, or accept payment for that specific gig outside of Vycinity, including but not limited to cash, Venmo, Cash App, Zelle, PayPal, or any other off-platform method.

What's allowed. Hirers and Workers may exchange contact information (phone numbers, emails, social handles) freely. Once introduced through Vycinity, you are free to engage in future, separate work arrangements outside the platform. Those relationships are yours.

What's not allowed. Posting a gig on Vycinity and then arranging payment for that same gig off-platform, even if contact details were exchanged earlier is a violation of these Terms. It deprives both parties of Vycinity's protections (escrow, auto-release, dispute resolution, ratings) and constitutes fee evasion.

Violations may result in suspension or permanent ban of one or both accounts, forfeiture of any pending earnings, and may be referred to authorities where applicable. Vycinity reviews disputes and behavioral patterns using gig records and conversations retained consistent with our Privacy Policy.

9. Subscriptions and Cancellation

Premium subscriptions automatically renew at the end of each billing period. You may cancel at any time:

Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods unless required by applicable law.

Users may leave reviews after completing a gig. By submitting a review, you grant Vycinity a non-exclusive, royalty-free license to display that content on the Service. Reviews must be honest and based on your genuine experience. Fraudulent, defamatory, or abusive reviews may be removed.

12. Intellectual Property

The Vycinity name, logo, design, and all related materials are the exclusive property of Vycinity and are protected by applicable intellectual property laws. You may not use our trademarks or branding without prior written permission.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. VYCINITY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER ON OR OFF THE PLATFORM.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VYCINITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY GIGS ARRANGED THROUGH IT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE FEES PAID BY YOU TO VYCINITY IN THE PAST 12 MONTHS.

15. Indemnification

You agree to indemnify and hold harmless Vycinity and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

16. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may close your account at any time by contacting us.

17. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Maricopa County, Arizona.

18. Changes to Terms

These Terms may change at any time, with or without notice, in connection with any update to the Vycinity application or website. Material changes will be reflected by posting the updated Terms on this page and updating the "Last updated" date above. By continuing to use the Service after changes are posted, including by opening, logging into, or otherwise interacting with the app or website after an update, you agree to be bound by the revised Terms. If you do not agree to a change, you must stop using the Service.

For significant changes (such as new fees, changes to the dispute resolution process, or new prohibited conduct), we will use reasonable efforts to provide additional notice through the app or by email to the address associated with your account.
